Cooling-Off Period When Buying a Home in the Netherlands

The cooling-off period when buying a home in the Netherlands gives you a legal window to reconsider after signing a purchase agreement,  without losing your deposit.

Under Dutch law, this protection lasts three calendar days and applies to every residential property purchase.

Here is exactly how it works, when it starts, and what you need to do if you want to use it.

What Is the Cooling-Off Period (Bedenktijd) in the Netherlands?

The bedenktijd — Dutch for ‘reflection period’ — is a statutory right for home buyers under Article 7:2 of the Dutch Civil Code. It gives you three calendar days to cancel a signed purchase agreement without having to give a reason and without any financial penalty.

This right exists only for the buyer. The seller cannot cancel under the cooling-off provision, they are bound once both parties have signed.

When Does the Cooling-Off Period Start?

The three-day period begins on the day after the buyer receives a copy of the signed purchase agreement (voorlopig koopcontract). This is an important detail: it is not from the moment of signing, but from the day after the signed contract reaches the buyer.

If the third day falls on a Sunday, a public holiday, or a Saturday, the period is extended to the next working day. This means your effective window is always at least three full working days.

What Happens If You Cancel During the Cooling-Off Period?

If you cancel within the bedenktijd, the purchase agreement is dissolved and you are not required to pay any penalty or forfeit any deposit. The cancellation must be in writing, typically a signed letter or email, and must reach the seller (or their agent) within the three-day window.

Your buyer’s agent (aankoopmakelaar) will normally handle this for you. If you are buying without an agent, send your cancellation in writing to the seller’s makelaar and keep a timestamped record.

Can the Seller Also Cancel During the Cooling-Off Period?

No. The bedenktijd applies only to the buyer. Once both parties have signed, the seller is legally bound. They cannot use the cooling-off period to back out if they receive a higher offer.

The Cooling-Off Period vs Resolutive Conditions (Ontbindende Voorwaarden)

The bedenktijd and ontbindende voorwaarden (resolutive conditions) are two separate mechanisms. The cooling-off period is automatic, it applies to every residential purchase. Resolutive conditions are contractual clauses you negotiate with the seller before signing.

The two most common resolutive conditions expat buyers include are:

Financieringsvoorbehoud — mortgage condition: you can cancel without penalty if your mortgage is not approved by the agreed deadline (usually four to six weeks)
Bouwkundige keuring — structural inspection clause: you can cancel or renegotiate if the inspection reveals defects above an agreed cost threshold

These conditions give you much longer protection than the three-day cooling-off period.

If you are at all uncertain about your mortgage or the property’s condition, make sure these are in your purchase agreement.

Important Limitation: The Six-Month Rule

There is one restriction expat buyers should be aware of. If you cancel a purchase agreement using the cooling-off period, you cannot use the same cooling-off right again on the same property within six months. This prevents buyers from repeatedly signing and cancelling to block a property.

Frequently Asked Questions

Does the cooling-off period apply to new-build (nieuwbouw) properties?
The standard bedenktijd applies to existing properties. New-build purchases follow a different process and have their own cooling-off rules. Always check the specific terms in your new-build purchase contract.
What if I signed the contract but have not yet received a copy?
The three-day period does not start until you receive a copy of the signed agreement. If your agent has not sent you one, request it immediately — your cooling-off window has not started yet.
Can I use the cooling-off period if I simply change my mind?
Yes. The bedenktijd requires no reason. You can cancel for any reason — or no reason at all — within the three-day window, in writing.
Do I still get my deposit back if I cancel within the cooling-off period?
If you cancel within the bedenktijd, the purchase agreement is dissolved and no deposit is payable. If you cancel after the cooling-off period without a valid resolutive condition, you typically forfeit a 10% penalty of the purchase price.

Jessica Venn

A lawyer and lecturer from Johannesburg who relocated to the Netherlands in 2018 after first living for a short time in Dubai. Jessica studied B Com Law and LLB and after completing her articles in law, she started lecturing law to university students. In 2011 she opened up her own law firm specializing in Consumer Law and Contracts. After relocating and running her business remotely, Jessica closed her firm in 2020 and became a full-time mom to her two little boys.

Going from running my own law firm to being a full-time mom has been an interesting journey. Moving to a new country (twice) definitely kicked my networking skills into a higher gear! As an expat you have to learn how to make new friends, find your way around a new city, and integrate into a different culture and community. From the moment I landed in Dubai I felt the need to want to help others integrate more easily and make them feel supported even though their own family and friends were far away. Helping expats find a home is an integral part of the relocation process. Offering the best support while taking that step is exactly what I want to provide to my clients. Now here in the Netherlands at Homes for Expats I get to do exactly that! Relocating is not for the faint-hearted but it is worth it! Let me help you find your home!
